2. The movement of vehicle and load upon said roadway shall be during daylight hours only. Permits are not valid on Sundays, nor during the period beginning at 12 noon on the day preceding every legal holiday here listed: New Year’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, Christmas Day, except with the approval of the Weighmaster/Permit Coordinator when emergency repair movements are necessary in the best interest of public safety and welfare.
3. The movement shall not impede other traffic in an unreasonable manner and at no time shall traffic be blocked from use of the roadway. Vehicles and loads shall not be parked on the roadway at any time.
4. Vehicles shall be registered as required by the Michigan vehicle code and will not violate any statute or valid ordinance, rule or regulation by any state agency or sub-division of the state. Vehicles are to comply with all statutory provisions as to other permits, licensing, motor vehicle equipment and operation.
5. The driver of the vehicle shall carry this original permit in the vehicle to which it applies and shall have it available for inspection by any police officer or Weighmaster of a road commission or motor carrier officer.
6. Applicant shall be responsible for any damage caused to wires, mailboxes, trees, buildings, or the road, including the structures and appurtenances, and shall reimburse the appropriate parties for any damage caused by the moving of said vehicle or load.
7. Permits are not valid if insurance expires. Applicant is to present evidence that minimum insurance coverage is met (see Policy for Insurance Requirements).
8. Permits will be issued only for vehicles owned by the applicant or operated under a bona fide lease or rental agreement.
9. Permits will not be issued for oversize or overweight vehicles or loads that can be readily dismantled, reduced or otherwise rearranged to come within the legal limits. Permits will in no way supersede posted axle loading limits on any bridge or roadway. The applicant agrees to reimburse the road commission for any damage resulting from disregard of such postings.
10. The road commission may temporarily suspend an Agriculture Single Move Permit, either in its entirety or in respect to certain of its provisions, due to seasonal or other special conditions.
11. The vehicle shall not be loaded or unloaded within the outer shoulder limits of any county road unless permitted by the road commission.
12. Permits are issued only to business entities or individuals actually doing the transporting. The transporting vehicles to be used must be owned by the applicant or operated under a bona fide lease or rental agreement.
13. The issuance of permits is limited to those vehicles and/or loads that cannot reasonably be divided, dismantled, reduced, or otherwise rearranged to conform to legal dimensions and/or weights as provided by law.
14. On the route designated on the Agriculture Single Move Permit, this temporary seasonal permit allows this vehicle to transport agricultural commodities at or below normal loading maximum per 257.722 of the Michigan Vehicle Code during the current year seasonal weight restriction period. Per 257.722 (1) the maximum axle load shall not exceed the number of pounds designated in the following provisions that prescribe the distance between axles.
a. If the axle spacing is 9 feet or more between axles, the maximum axle load shall not exceed 18,000 pounds for vehicles equipped with high pressure pneumatic or balloon tires.
b. If the axle spacing is less than 9 feet between 2 axles but more than 3-1/2 feet, the maximum axle load shall not exceed 13,000 pounds for vehicles equipped with high pressure pneumatic or balloon tires.
c. If the axles are spaced less than 3-1/2 feet apart, the maximum axle load shall not exceed 9,000 pounds per axle.
d. (a), (b), and (c) are known as the normal loading maximums.
